1. Introduction
1.01
Senses World Sdn Bhd is a company that market exclusive aromatherapy courses and essential oil products through its unique concept that encourages and supports the use and retail sales of its products through independent marketing Agents. However, Senses World Sdn. Bhd. is not a direct selling or multi-level marketing company; our philosophy is to provide the best knowledge and products to our consumers and marketing agents, in order to help more people to sleep well and live well.
1.02
My Senses is a brand owned by Senses World Sdn Bhd, hereafter referred to as “My Senses”.
1.03
(a) Company Policies and the Code of Professional Conduct have been implemented to provide restrictions, rules and regulations for proper sales and marketing procedures and to prevent improper, abusive or illegal acts. Such Company Policies and the Code of Professional Conduct are revised, modified and added to, from time to time.
(b) My Senses does not represent that an Agent will achieve financial success without working or by relying solely on the efforts of others. Compensation in MY SENSES is based upon the sale of its products. Each Agent is an independent contractor whose success or failure depends on personal effort.
(c) The fundamental goal of the MY SENSES marketing plan is to promote the sale and use of high quality products to consumers. The primary purpose of the Agent is to promote the sale and use of these products to consumers, directly and by building a sales organization.
(d) The Agent regardless of his/her level in the MY SENSES Agent Marketing Plan is encouraged to make retail sales each month and keep records of such sales.
(e) A successful Agent gains current knowledge of the market by attending training meetings, maintaining personal retail customers, and referring other Agents to sell to retail customers.

1.04
(a) The Code of Professional Conduct shall be published on the MY SENSES Company website at www.mysensesworld.com and shall become effective 14 days after publication.
(b) Each Agent has an obligation to become familiar with the Company Policies and the Code of Professional Conduct in existence at the time of enrolment and as revised, modified or amended by the Company.
(c) Each Agent, upon signing the My Senses Agent Application form, agrees to abide by MY SENSES Company Policies and the Code of Professional Conduct. Language therein specifically refers to the Agent’s contractual commitment to follow MY SENSES Company Policies and the Code of Professional Conduct. The placing of orders for product with MY SENSES is a reaffirmation of such commitment to abide by the Company Policies and the Code of Professional Conduct. Any acts or lack of action, which results in a misuse, misrepresentation or violation of the Company Policies and/or the Code of Professional Conduct, may cause termination of the license granted to use MY SENSES’s registered trademarks, service marks, and other marks, including the right to buy and distribute MY SENSES products.
(d) Notwithstanding the foregoing, any revision, modification, amendment to, or termination of (a) the Dispute Resolution/Waiver of Jury Trial agreement contained in these Company Policies and the Code of Professional Conduct and/or the agreements contained in the Dispute Resolution Policy referenced therein and available on MY SENSES’s Company website at www.mysensesworld.com, shall not apply to a dispute of which the Company has actual notice of prior to the effective date of such revision, modification, amendment or termination. The effective date of any such revision, modification, amendment or termination shall be 14 days after the revision, modification, amendment or termination is posted on the MY SENSES Company website at www.mysensesworld.com.
2. Definitions
Retail Price (RP): The price, not including taxes, at which the Company recommends that products be sold to Retail Customers.
Personal Purchase (PP): The purchase made by your own agent’s account.
Sales Point (SP): All products are assigned with a Sales Point. The valuation of the Sales Point is decided by the company. This Sales Point is used to calculate for all bonuses, except for Retail Profit.
Personal & Non-Associate (P&NA): The Sales Points (SP) arrived from your personal purchase (PP) plus all your agents, except for your Associate Agents and agents under their organization.
Associate Sales Point (ASP): The Sales Points (SP) arrived from your Associate Agents and agents at lower ranking under their organization when you meet the Personal and Non-Associate Sales Points Requirements, as follows:
i) P&NA SP 1,000 & above – receives 100% of the Sales Points generated by the 1st Level of Qualified Associates.
ii) P&NA SP 2,000 & above – receives 100% of the Sales Points generated by the 2nd Level of Qualified Associates.
Reward Point (RP): All level of Agents will earn Reward Points, calculated based on 1% on the Sales Points (SP) from every personal purchase. The Reward Points can be used to redeem against gifts and items determined by the company, such as Products, Workshops, Courses, Premium items, etc. and all Reward Points must be utilized within 24 months. All unutilized Reward Points will be forfeited. Reward Points are not transferrable and not exchangeable for Cash.
Retail Customer: One who purchases MY SENSES products through authorized channels and has not yet applied to be an Agent by submitting an Application to the Company.
Referrer Agent: One who referring someone to his/her sales organization.
Active Agent (Shopper, Wholesaler and Director): An Agent, except for Associate Agent, who has 100 Sales Point (SP) or more by personal purchase (PP) during a calendar year. The Active status of an Agent is part of the qualification requirement to receive Retail Discount and bonuses.
Active Associate Agent: An Associate Agent, who has 1,000 Personal & Non-Associate Sales Point (P&NA SP), where at least 100 SP is from Personal Purchase (PP), during a calendar year. The Active status of an Agent is part of the qualification requirement to receive Retail Discount and all bonuses.
Qualified Associate Agent: An Qualified Agent, who has 1,000 Personal & Non-Associate Sales Point (P&NA SP), where at least 100 SP is from Personal Purchase (PP), during a month. The Qualified status of an Associate Agent is part of the qualification requirement to receive 3-Tier Bonus.
Bonus: A cash payment from the Company to a Qualified Agent.
(a) Personal Bonus (PB):
• A direct discount of 10-%20% of the Retail Price of his/her personal purchase of MY SENSES products.
• A bonus payment of 10%-20% of the Retail Price of his/her personally-referred Retail Customers of MY SENSES products.
• A bonus payment of 15%-35% of the Sales Points (SP) of the personal purchases of MY SENSES products.
(b) Over-riding Bonus (OB): A cash payment to a qualifying Agent of 10%-35% of the Sales Points (SP) of the Personal Accredited Sales of a downline Agent who is not under an Associate Agents.
(c) Same Level Bonus (SB): A cash payment to a qualifying Agent of 3% of the Sales Points (SP) generated by personally referred Direct Agent (at same or higher rank, first level only).
3. Product Return Policy and Warranty
3.01 If any damaged, defective or incorrect items are received, refund or replacement request is only valid within fourteen (14) days after the parcel is received. My Senses may refund the purchase price (plus applicable tax if prepaid) of currently Marketable products that are returned by an Agent or Customer due to the above reason(s), less shipping costs and paid Bonuses to all levels of Agents, if the request is approved by the company.
3.02
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
3.03
To complete your return, we require a receipt or proof of purchase. Any item not in its original condition, is damaged or missing parts for reasons not due to our error, will not be eligible for refund or replacement.
3.04 Refunds (if applicable)
Once your return item is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund or replacement.
3.05
If your request is approved, the refund will be processed and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
3.06
If you have not received your refund or replacement after submitted all the required information, please contact our customer service at mysensesworld@gmail.com
3.07
Senses World Sdn Bhd reserves the right to Recoup Unearned Bonuses. Bonuses are paid to Agents based on the purchase of Company products by retail customers or by members of their Agent Organization.
3.08
When products are returned, the Company has the right to recoup the Bonuses that were paid based on the purchase of the products that were returned. The Company may recoup these Bonuses by requiring an Agent to pay the Company directly, or the Company may withhold the amount of the Bonus from future Bonus payments.
3.09 Replacement (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at mysensesworld@gmail.com and send your item to the following Shipping address.
However, when a replacement is not feasible, the Company reserves the right to issue a credit for the amount of the exchanged products.
3.10 Shipping
To return your product, you should mail your product to:

3.11
You will be responsible for the shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
3.12
This refund procedure may vary in jurisdictions where different repurchase requirements are imposed by law. Applicable laws may dictate the terms of the refund policy.
3.13
Senses World Sdn Bhd reserves the rights to alter and/or amend the above Product Return Policy as and when needed, without prior notice.
4. Bonus Structure / Marketing Plan
4.01
Upon becoming an Authorized Agent with the right to sell MY SENSES products and refer other Agents to sell MY SENSES products. The combined sales volume (measured in Sales Points – SP) generated by the Agent and his/her subsequent organization qualify the Agent to receive Sales Level promotions, and increased Discounts and Bonuses as outlined below.
4.02 Shopper Agent (SA)
To qualify as Shopper Agent, the following must be achieved, unless otherwise noted:
• One who, having purchased any products from My Senses platform at 10% Discount from Retail Price, within 24 hours after receiving the confirmation email.
The Shopper Agent receives:
• 10% Discount on Retail Price for personal purchase.
• 3% Same Level Bonus on the Sales Points (SP) generated by personally referred Agent (same or higher rank, first level only).
• In order to receive Same Level Bonus, the Shopper Agent need to achieve minimum 100 Personal Purchase Sales Points (SP).
• Please note that the above discount rates are for MY SENSES products only; for non-MY SENSES products, the discount will differ, depending on the individual product.
• 1% Reward Points (RP) on Personally Purchase products, calculated based on the Sales Points (SP). Reward Points are used to redeem gifts and/or items determined by the company and has expiry date of not more than 24 months.
4.03 Wholesaler Agent (WA)
To qualify as Wholesaler Agent, the following must be achieved, unless otherwise noted:
• Wholesaler Agent is achieved by generating a total of one thousand 300 Sales Points (SP) by personal purchase in any particular month.
The Wholesaler Agent receives:
• 20% Discount on Retail Price for personal purchase (My Senses products only).
• 15% Personal Bonus on Personally Purchase products, calculated based on the Sales Points (SP).
• 10% Over-riding Bonus on the Retail Price (RP) and 15% Over-riding Bonus on the Sales Points (SP) generated by personally referred Shopper Agent(s) and their downline agents, excluding agents that with higher ranking than Shopper Agent.
In order to receive Over-riding Bonus, the Wholesaler Agent has to achieve minimum 100 Personal Purchase Sales Points (SP).
• 3% Same Level Bonus on the Sales Points (SP) generated by personally referred Wholesaler Agent (at same or higher rank, first level only).
In order to receive Same Level Bonus, the Wholesaler Agent has to achieve minimum 100 Personal Purchase Sales Points (SP).
• 1% Reward Points (RP) on Personally Purchase products, calculated based on the Sales Points (SP). Reward Points are used to redeem gifts and/or items determined by the company and has expiry date of not more than 24 months.
4.04 Director Agent (DA)
To qualify as Director Agent, the following must be achieved, unless otherwise noted:
• Director Agent is achieved by generating a total of ten thousand 2,500 Sales Points (SP) in any particular month by:
(a) personal purchase, or
(b) combine sales volume of 5,000 Sales Points (SP) by agents in his/her organization (except for Associate Agents), where 500 Sales Points (SP) must be generated by personal purchase.
The Director Agent receives:
• 20% Discount on Retail Price for personal purchase (My Senses products only).
• 25% Personal Bonus on Personally Purchase products, calculated based on the Sales Points (SP).
• 10% Over-riding Bonus on the Retail Price (RP) and 25% Over-riding Bonus on the Sales Points (SP) generated by personally referred Shopper Agent(s) and their downline Shopper agents, excluding agents that with higher ranking than Shopper Agent.
• 10% Over-riding Bonus on the Sales Points (SP) generated by personally referred Wholesaler Agent(s) and their downline agents, excluding agents that with higher ranking than Wholesaler Agent.
In order to receive Over-riding Bonus, the Director Agent has to achieve minimum 100 Personal Purchase Sales Points (SP).
• 3% Same Level Bonus on the Sales Points (SP) generated by personally referred Director Agent (at same or higher rank, first level only).
In order to receive Same Level Bonus, the Director Agent need to achieve minimum 100 Personal Purchase Sales Points (SP).
• 1% Reward Points (RP) on Personally Purchase products, calculated based on the Sales Points (SP). Reward Points are used to redeem gifts and/or items determined by the company and has expiry date of not more than 24 months.
4.05 Associate Agent (AA)
To qualify as Associate Agent, the following must be achieved, unless otherwise noted:
• Associate Agent is achieved by generating a total of twenty thousand 5,000 Sales Points (SP) in any particular month by:
(a) personal purchase, or
(b) combine sales volume of 10,000 Sales Points (SP) by agents in his/her organization (except for Associate Agents), where 1,000 Sales Points (SP) must be generated by personal purchase.
c) If an Agent’s downline Agent also qualifies as an Associate Agent during the same period, the Agent will be qualified as an Associate Agent if
i) He/she is an Active Agent during the same period, and
ii) He/she has at least 1,000 Personal Purchase Sales Points (SP) in the month of qualification from Agents in downlines other than that of the Associate Agent moving up in the same Month.
The Associate Agent receives:
• 20% Discount on Retail Price for personal purchase (My Senses products only).
• 35% Personal Bonus on Personally Purchase products, calculated based on the Sales Points (SP).
• 10% Over-riding Bonus on the Retail Price (RP) and 35% Over-riding Bonus on the Sales Points (SP) generated by personally referred Shopper Agent(s) and their downline Shopper agents, excluding agents that with higher ranking than Shopper Agent.
• 20% Over-riding Bonus on the Sales Points (SP) generated by personally referred Wholesaler Agent(s) and their downline agents, excluding agents that with higher ranking than Wholesaler Agent.
• 10% Over-riding Bonus on the Sales Points (SP) generated by personally referred Director Agent(s) and their downline agents, excluding agents that with higher ranking than Director Agent.
In order to receive Over-riding Bonus, the Associate Agent has to achieve minimum 100 Personal Purchase Sales Points (SP).
• 1% Reward Points (RP) on Personally Purchase products, calculated based on the Sales Points (SP). Reward Points are used to redeem gifts and/or items determined by the company and has expiry date of not more than 24 months.
The Associate Agent is eligible to:
• Receive 3-tier Associate Agent Bonus.
• participate in the Profit Sharing Bonus program.
• participate in the Incentive Trip program.
• Receive 100% of the Associate Sales Points (ASP) generated from the 1st level of his/her Qualified Associate Agent(s).
• Receive 100% of the Associate Sales Points (ASP) generated from the 2nd level of his/her Qualified Associate Agent(s).
4.06 Agent 12-month and 24-month Policy.
a) For Wholesaler and Director Agent, who have not made at least 100 Sales Points (SP) personal purchase in any month for 12 consecutive calendar months will be automatically demoted to Shopper Agent level.
b) For Associate Agent, who does not generate at least 1,000 P&NA Sales Points (SP) in any month, where 100 Sales Points (SP) must be personal purchase, in any month for 12 consecutive calendar months will be automatically demoted to Shopper Agent level.
b) A Shopper Agent who has not made any purchase for 24 consecutive calendar months will be automatically removed from the Company’s database and forfeit all rights to any downline agent organization and any bonuses or other benefits generated thereby.
4.07 Activity Qualification
(a) To qualify for all Bonuses and Incentives, except Personal Discounts, an Agent must be Active and meet all other requirements of the Marketing Plan during the calendar month in which the bonuses were accrued.
(b) An Agent who does not meet the requirements of the Marketing Plan, will not be paid an Over-riding Bonus and Same Level Bonus that month. Any unearned Over-riding Bonus will be paid to the next Active Superior Agent. In turn, his/her bonus will be paid to the next Active Superior Agent and so on.
(c) An Agent who forfeits any Over-riding Bonus may re-qualify the following month (with no retroactive application) as an Active Agent and meet the requirements of the Marketing Plan.
(d) An Agent who has been demoted to Shopper level as per the 12-Month Policy or removed from the Company’s database per the 24-Month Policy is eligible to be sponsored again in any Agent line, but without a restoration of any previous Agent Level or downline agent organization.
4.08 Bonus Calculations and Payments.
(a) For MY SENSES products, all bonuses are calculated on the Sales Points (SP) as set forth in the Agent’s monthly bonus statement.
(b) For MY SENSES products, all discounts are calculated on the Retail Price. Please note that for local/non-MY SENSES products, a different percentage of discount will be applied, depending on the individual product.
(c) Discounts and bonuses are calculated based on the level reached when the order is accepted in the current month. Higher discounts and bonuses are effective in the month of upgrading to a higher level.
(c) An Agent does not receive an Over-riding Bonus on any Agent in his/her referred group who is at the same level in the marketing plan. However, he/she may receive a Same Level Bonus if he/she meets the requirements in the marketing plan.
(d) Bonuses are paid on the twentieth (20th) of the month following that in which product was purchased from the Company. Example: bonuses for January purchases are paid on February 20th.
(e) Any 3rd-party charges or fees accrued on payments made to an Agent outside the Country in which the Profits/Bonuses are earned will be the responsibility of the Agent.
5. 3-Tier Associate Bonus
5.01
After an Agent becomes an Associate Agent, he/she can qualify 3-Tier Associate Bonus by developing and supporting Agents by continuing to refer and train Agents.
5.02
(a) An Associate Agent who is Active and has 1,000 Personal and Non-Associate (P&NA) Sales Points (SP) during the current month where 100 Sales Points (SP) must be generated by personal purchase, qualifies for 5% of 3-Tier Associate Bonuses generated during that month by the Personal and Non-Associate Sales Points (P&NA SP).
(b) An Associate Agent who is Active and has 2,000 Personal and Non-Associate (P&NA) Sales Points (SP) during the current month where 100 Sales Points (SP) must be generated by personal purchase, qualifies for 5% of 3-Tier Associate Bonuses generated during that month by the first level of the Qualified Associate Agent.
(c) An Associate Agent who is Active and has 3,000 Personal and Non-Associate (P&NA) Sales Points (SP) during the current month where 100 Sales Points (SP) must be generated by personal purchase, qualifies for 5% of 3-Tier Associate Bonuses generated during that month by the second level of the Qualified Associate Agent.
5.03
An Associate Agent who is not Active, has not made a purchase for 12 consecutive calendar months, loses eligibility to qualify 3-Tier Associate Bonus.
6 Profit Sharing Bonus
6.01
All Company incentive programs are intended to promote sound business building principles. This includes the proper referring and selling of product in usable, resalable quantities. Incentive sales points and prizes are not transferable, and will be awarded only to the Agent who qualifies by building the business in accordance with the letter and spirit of the MY SENSES Marketing Plan and Company Policies and the Code of Professional Conduct.
6.02
A Profit Sharing Bonus Level-1 Incentive will be declared by the company when at least 5,000,000 Total Sales Points (SP) are achieved in a calendar year.
A Profit Sharing Bonus Level-2 Incentive will be declared by the company when at least 10,000,000 Total Sales Points (SP) are achieved in a calendar year.
6.03 Core Requirements for All Levels
An Agent, after becoming an Associate Agent, must fulfil ALL of the following requirements:
• Be an Active Associate Agent and achieve a minimum of 100 Sales Points (SP) per month by personal purchase during the incentive period from 1st January to 31st December.
• Be 3-Tier Associate Bonus qualified (even if he/she does not have any downline Associate Agent). Sales Points (SP) generated during the months he/she is not 3-Tier Associate Bonus qualified will NOT count toward this incentive.
3. Purchase products as required only after 60% of prior product inventory has been utilized.
4. If an Agent achieves Associate Agent during the qualification period, the Profit Sharing Bonus requirements are NOT prorated; the AGENT needs to accomplish the full requirements during the remainder of the qualification period after achieving Associate Agent level.
5. Build the MY SENSES business according to correct business principles and Company Policies and the Code of Professional Conduct.
6. Attend and support Company sponsored events.
7. Final acceptance into the Profit Sharing Bonus Incentive is subject to approval by the management of the company. The management will take into account all the provisions in the Company Policies and the Code of Professional Conduct.
6.04 Profit Sharing Bonus Level 1
In addition to the Core Requirements, the following must be achieved, unless otherwise noted:
• Accumulate 50,000 Personal and Non-Associate (P&NA) Sales Points (SP) during the incentive period after becoming an Associate Agent,
• Accumulate 200,000 Associate Sales Points (ASP) during the incentive period after becoming an Associate Agent,
• Be 3-Tier Associate Bonus qualified (1,000 P&NA Sales Points) for at least 10 months during the incentive period.
• Qualifiers will be eligible to share the Profit Sharing Pool accordingly to his/her Total Sales Points in a calendar year.
6.05 Profit Sharing Bonus Level 2
In addition to the Core Requirements, the following must be achieved, unless otherwise noted:
1. Personal qualify for Profit Sharing Bonus Level 1 (refer 6.04).
2. Develop at least 3 Profit Sharing Bonus qualifiers in any generation from 3 separate Agent lines.
3. Qualifiers will be eligible to share the Profit Sharing Pool accordingly to his/her Total Sales Points in a calendar year.
6.06 Profit Sharing Bonus Incentive Calculation.
• 1.5% from total Sales Points generated by the company in a calendar year will be allocated to Profit Sharing Level 1 Pool, provided the requirements are fulfilled (refer 6.02).
• 1.5% from total Sales Points generated by the company in a calendar year will be allocated to Profit Sharing Level 2 Pool, provided the requirements are fulfilled (refer 6.02)
• A bonus pool will be determined and then allocated as follows:
• The pool of Profit Sharing Level 1 will be paid to those who qualify in Level 1 & 2.
• The pool of Profit Sharing Level 2 will be paid to those who qualify in Level 2.
• The qualifying Agent will be awarded one Incentive Share for each of his/her Total Sales Points generated plus the Incentive Shares generated by the first Profit Sharing Qualifier in each of his/her sponsorship lines.
• Each pool division will be divided by the grand total Incentive Shares of all Profit Sharing Qualifying Agents who qualified for that pool division to determine the money factor for that division. This money factor will be multiplied by the Incentive Shares of each individual qualifier to arrive at the payment amount of the Incentive.
7 Incentive Trip
7.01
An Incentive Trip will be declared by the company when at least 3,000,000 Total Sales Points (SP) are achieved in a calendar year.
7.02
An Agent can qualify for a trip for one or two to the destination decided by the company (within Asia), including airfare, lodging, meal and activity allowances.
7.03 Core Requirements for Incentive Trip
An Agent, after becoming an Associate Agent, must fulfil ALL of the following requirements:
• Be an Active Associate Agent and achieve a minimum of 100 Sales Points (SP) per month by personal purchase during the incentive period from 1st January to 31st December.
• Be 3-Tier Associate Bonus qualified (even if he/she does not have any downline Associate Agent). Sales Points (SP) generated during the months he/she is not 3-Tier Associate Bonus qualified will NOT count toward this incentive.
3. Purchase products as required only after 60% of prior product inventory has been utilized.
4. If an Agent achieves Associate Agent during the qualification period, the Profit Sharing Bonus requirements are NOT prorated; the Agent needs to accomplish the full requirements during the remainder of the qualification period after achieving Associate Agent level.
5. Build the MY SENSES business according to correct business principles and Company Policies and the Code of Professional Conduct.
6. Attend and support Company sponsored events.
7. Final acceptance into the Incentive Trip is subject to approval by the management of the company. The management will take into account all the provisions in the Company Policies and the Code of Professional Conduct.
7.04 Incentive Trip for 1pax
In addition to the Core Requirements, the following must be achieved, unless otherwise noted:
1. Accumulate 36,000 Personal and Non-Associate (P&NA) Sales Points (SP) during the incentive period after becoming an Associate Agent,
2. Accumulate 100,000 Associate Sales Points (ASP) during the incentive period after becoming an Associate Agent,
3. Be 3-Tier Associate Bonus qualified (1,000 P&NA Sales Points) for at least 8 months during the incentive period.
4. Qualifiers will be entitled to a trip for one (1) person to the destination decided by the company (within Asia), including airfare, lodging, meal and activity allowances.
5. This Incentive Trip is not exchangeable for cash and not transferable.
7.05 Incentive Trip for 2pax
In addition to the Core Requirements, the following must be achieved, unless otherwise noted:
1. Personal qualify for the Incentive Trip (refer 7.04).
2. Develop at least 2 Incentive Trip qualifiers in any generation from 2 separate Agent lines.
3. Qualifiers will be entitled to a trip for two (2) persons to the destination decided by the company (within Asia), including airfare, lodging, meal and activity allowances.
4. This Incentive Trip is not exchangeable for cash and not transferable.
8 Re-sponsoring Policies
8.01
An existing Agent can re-sponsor under a different Referrer provided that, during the preceding 12 months, he/she has:
• Been an Agent, and
• Not purchased or received any MY SENSES products, either from the Company or from any other source, and
• Not received payments of any kind from an Agent, and
• Not referred any other individuals to become MY SENSES Agent.
• Submit application to My Senses and approved by the management.
8.02 Spouse
If the spouse of a legally married Agent who is not being re-sponsored wishes to create his/her own My Senses Business, he/she must do so by sponsoring directly under his/her spouse or directly under the spouse’s Referrer Agent.
8.03
A re-sponsored Agent begins again as Shopper Agent under the new Referrer Agent and loses any downline Agents acquired to that point in all countries into which he/she was previously sponsored.
9 Prohibited Activities
9.01
The Executive Committee’s decision to terminate a My Senses Business or to disallow, realign or adjust Bonuses, Sales Points, compensation or any incentive awards for any Agent’s involvement in activities or commissions that are not in conformance with Company Policies or the Code of Professional Conduct shall be final. Intentional acts of omission and disregard for the Company Policies or the Code of Professional Conduct by an Agent shall be severely dealt with which may include termination and legal action for damages.
9.02
Prohibited activities causing grounds for termination and liability for any damages caused by such acts include, but are not limited to, the following conduct:
(a) Fraudulent Sponsoring. An Agent is prohibited from sponsoring individuals without the knowledge of and execution of a My Senses Agent Application and Agreement by such individuals; the fraudulent sponsoring of an individual as an Agent; or the sponsoring or attempted sponsoring of non-existent individuals as Agents or Customers (“phantoms”) to qualify for commissions or bonuses.
(b) Proxy Purchasing. An Agent is prohibited from purchasing product in any other than his/her own name.
(d) Selling to Another Agent. In addition to retail activities, an Agent is prohibited from selling product to any Agent other than his/her personally-sponsored Agents, but at not less than the discounted price the Agent entitled to. Any other sale to another Agent, either directly or indirectly, is a prohibited transaction for both the selling and the buying Agent. The equivalent Sales Points of such a prohibited sale shall not be allowed for purposes of meeting the Active requirement or qualification requirement for any other benefits within the Agent Marketing Program. Resulting adjustments shall be made for this non-compliance.
(e) An Agent is prohibited from engaging in activities that are prohibited in all sections of 17.10 (Internet Policies), 19.02 (use of company mark), and 20 (confidential and non-disclosure agreement) as set forth herein.
(f) An Agent is prohibited from appearing in, being referenced in, or allowing the AGENT’s name or likeness to be featured or referenced in any promotional, referring or solicitation materials for another direct sales company.
(g) An Agent is prohibited from any action or failure to act which evidences intentional disregard and gross negligence of Company Policies.
(h) Selling in Stores.
i) Except as herein provided in this Section below, an Agent is prohibited from permitting Company products to be sold or displayed in retail stores, flea markets, or like exhibitions. However, exhibitions for a period of less than one week in a twelve-month period at the same venue are considered temporary and are therefore permitted after receiving written approval from the management of My Senses.
ii) An Agent who has a service-oriented office, barber shop, beauty shop or health club is permitted to display and sell products within that office, shop or club. However, exterior signs or window displays by such Agent to advertise the sale of Company products are prohibited.
iii) An Agent is prohibited from selling or marketing My Senses brand products except that it be in its original packaging.
(i) Using Unauthorized Literature. The Company’s prior written approval is required to use, produce or sell any sales aid or materials, other than those provided by MY SENSES.
i) An Agent is prohibited from promoting or selling any sales aid, training materials, websites or Apps not provided by MY SENSES, except to Agents within his or her own organization.
ii) Such materials offered for sale to his or her own Agents must be approved by MY SENSES, and be sold at a reasonable price.
(j) Selling Online. An Agent is prohibited from transacting the sale of My Senses product using any internet based sales channel other than the Company provided retail storefront at www.mysensesworld.com, My Senses Mobile APP or Company approved 3rd party website.
(k) Selling to Others for Resale. An Agent is prohibited from selling MY SENSES products to anyone for the purpose of resale or entrusting others to sell MY SENSES products.
(l) Sponsoring an Agent into Another Company. An Agent is prohibited from, directly or indirectly, contacting, soliciting, persuading, enrolling, sponsoring or accepting any Agent, MY SENSES customer or anyone who has been an Agent or Customer within the last twelve (12) months, into, or encouraging any such person in any way to promote opportunities in marketing programs of any competitor’s company other than MY SENSES.
(m) An Agent is prohibited from disparaging other Agents, MY SENSES’s products/services, the Marketing and Compensation Plan, or MY SENSES’s employees to other Agents or third-parties. Any questions, suggestions or comments regarding these issues should be directed in writing to MY SENSES’s offices only.
(n) Making Product Claims. Agents may not make any representation, expressly or by implication, that My Senses products can prevent, diagnose, treat or cure any disease or medical condition. My Senses products that are intended to be ingested into the body are purely nutritional and/or nutritional supplements and are, therefore, regulated throughout the world as food. My Senses products that are intended to be used on the body are regulated throughout the world as cosmetics. My Senses does not produce or distribute any products that are to be considered or described as a medicine, treatment or cure.
(o) Making Earnings Claims. Agents may not make any representation, expressly or by implication, regarding the amount or level of income, including full-time or part-time income, that a prospective Agent can reasonably expect to earn. Implied representations of income that an Agent reasonably can expect to earn include, but are not limited to, representations and/or images used to show a dramatically improved, luxurious or lavish lifestyle.
(p) Operating Business by Proxy. A My Senses Business, and any resulting agents, created or operated by proxy, either intentionally or inadvertently, is prohibited, and shall be adjusted for compliance with Company Policies and the Code of Professional Conduct by the Executive Committee.
(q) Exporting Product. An Agent is authorized to purchase product for the purpose of selling and using said product in the country in which it was purchased. An Agent is prohibited from purchasing product for the purpose of exporting said products to a country outside the country in which it was purchased, except for his/her personal and family use in a country where there is no authorized MY SENSES office
(r) Advertising Price of Product. An Agent is prohibited from any form of advertising of our products at any price below the Suggested Retail Price. This includes a stated price or any other pricing formula that reduces the price paid for any My Senses product to below that of Standard Retail Price.
(s) An Agent is prohibited from attempting in any manner to induce, coerce or persuade any other Agent to terminate his or her position, cease doing business or reduce his or her business building activities for any reason.
10 Company Policies
10.01 The Agent relationship with MY SENSES is one of a contractual nature. Only adult individuals, 18 years of age or older, may contract with MY SENSES to be an Agent.
10.02 An AGENT is allowed, subject to specific conditions, to register a closely-held business entity to hold his/her My Senses Business. A closely-held business entity shall be defined as a business entity held by the original primary Agent, or if required by law or approved by MY SENSES, two (2) shareholders, owners, members or trustees will be allowed who must be directly involved in the day- to-day operation of the business (hereinafter referred to as the “Business Entity”). In addition to compliance with all of MY SENSES standard My Senses Business requirements and MY SENSES Company Policies and the Code of Professional Conduct, the individual Agent(s) will be required to execute a My Senses Business Entity Agreement, which shall supplement, be incorporated and considered part of the My Senses Agent Agreement, outlining the additional terms and conditions under which the AGENT agrees to operate as a Business Entity. The My Senses Business Entity Agreement can be obtained in the Forms and Downloads link available under My Senses Agent Dashboard after signing in as an Agent at www.mysensesworld.com
10.03 The Agent is solely responsible for seeking individual professional advice regarding the establishment of a business entity, its tax effects and any other contingent legal issues. MY SENSES explicitly disavows any responsibility and liability pertaining to an Agent’s decision to operate his/her My Senses Business as a Business Entity. MY SENSES does not represent nor shall give any tax, accounting or legal advice regarding assigning one’s My Senses Business to a Business Entity.
10.04 The Company shall not be liable for any loss of profit, indirect, direct, special or consequential damages, and for any other losses incurred or suffered by an Agent as a result of transferring one’s My Senses Business from his/her individual name to a Business Entity.
(a) An Agent is considered an Independent Contractor, and is required to conduct his/her business within the terms of the My Senses Business Agreement, and in compliance with the Company Policies and the Code of Professional Conduct that are applicable in the country in which he/she is conducting business.
(b) A My Senses Business consists of the person named on the My Senses Agent Application form on file at the management office. If the spouse of a legally married Agent wishes to create his/her own My Senses Business, he/she must do so by sponsoring directly under his/her spouse or directly under the spouse’s Referrer.
(c) An Agent shall be held responsible to properly manage his/her My Senses Business, specifically but not limited to, preventing family members from using information obtained through such My Senses Business to circumvent compliance of Company Policies and the Code of Professional Conduct required or evolving from the My Senses Business of the Agent. An Agent’s failure to properly manage his/her My Senses Business may result in termination.
(d) In the event that the downlines of an Agent sponsor into a foreign country and the Agent has not previously been sponsored into that country, the Agent will be automatically sponsored into that foreign country and agrees to the prevailing policies and local laws of that foreign country and agrees to be bound by the dispute resolution policies set forth herein.
10.05 MY SENSES agrees to sell the Agent product and pay Commission as provided in the Company Marketing Plan, provided the Agent is not in violation of such Agent’s contract with MY SENSES.
10.06 An Agent may develop his/her own marketing techniques, so long as they are not in violation of any Company, state, federal or jurisdictional rules, regulations or statutes.
10.07 Any transfer other than by inheritance of a My Senses Business, without prior Company approval, is prohibited and any such transfer shall be void. For the purpose of this provision, a change of beneficial interest of a Trust held My Senses Business shall be treated as a transfer, which requires written approval by the Company to be valid.
10.08 Except as herein provided, an Agent is prohibited from, directly or indirectly, changing Sponsors. MY SENSES will only consider the first valid Application received by the Management Office. Subsequent applications shall be disallowed.
10.09 When an Agent changes their residence to a different country, he/she must notify the old country of residence so that the address can be changed and a new Home Country assigned.
10.10 Errors or Questions. If an Agent has questions about or believes any errors have been made regarding bonuses, downline activity reports, charges, or changes, the Agent must notify MY SENSES within thirty (30) days of the date of the purported error or incident in question. MY SENSES is not responsible for any errors, omissions or problems not reported within thirty (30) days.
10.11 Voluntary Termination.
(a) An Agent may terminate his/her My Senses Business by submitting a written request, signed by all named individuals appearing on the current approved My Senses Business. The effective termination date is the date on which the management office accepts the termination request. The terminating Agent forfeits the current sales level and all downlines agents, including those in foreign countries, established at the time.
(b) Once an Agent terminates, the spouse (if on the same Agent Business) is also considered terminated.
(c) After 12 months, a terminated Agent may reapply subject to management approval. Upon such approval the Agent will enter as a Shopper Agent, and will not have the previous agent organization restored.
10.12 Termination or Suspension for Cause.
(a) Termination means a severance of all domestic and international privileges and contractual rights available to an Agent, including the privilege to buy and distribute the products. The Termination will result in the inability to qualify for Bonuses, and severance of participation in all other benefit programs sponsored by the Company.
(b) A terminated Agent shall, upon demand by MY SENSES, be liable to repay, return or compensate MY SENSES for any benefit programs, prizes, inventories, or bonuses received from MY SENSES from and after the date of the activities causing such Termination. After recouping any costs or damages resulting from the terminated Agent’s conduct, forfeited bonuses, caused by such Termination, shall be paid to the next qualifying Agent referrer who is not in violation of any of the Company Policies and the Code of Professional Conduct.
(c) After 12 months, a terminated Agent may reapply subject to management approval. Upon such approval the Agent will enter as a Shopper Agent, and will not have the previous agents organization restored.
(d) Suspension is a temporary status that prohibits an Agent from placing orders, receiving profit and bonus payments, and sponsoring other Agents.
(e) The profits and bonuses of a Suspended Agent shall be held until the Agent is either reinstated or terminated. If reinstated, the withheld payments shall be paid to the Agent; otherwise they shall be disbursed in accordance to the marketing plan.
10.13 Internet Policies
(a) Selling Products Online. In order to maintain the integrity of MY SENSES’s brand name, product line and the Agent/Customer relationship, an Agent is prohibited from selling any MY SENSES brand products online through their independent website. E- Commerce sales can only be made directly by or through a link to the official Company Webstore at www.mysensesworld.com.
(b) Sponsoring an Agent online via an electronic signature application or online form is prohibited outside of the direct application or link to the official Company website at www.mysensesworld.com or official Mobile APP.
(c) Independent Agent websites marketing and promoting the products or business opportunity, without online sales or sponsoring, are permitted so long as they comply with or are modified to comply with Company Policies and the Code of Professional Conduct.
(d) An Agent may not use the name “My Senses Living Products” or any of its trademarks, trade names, product names, domain name (URL) or copy or use any Company materials from any source that may result in misleading or confusing the user into thinking the Agent’s website is that of the Company or any of its official affiliates. MY SENSES product names are strictly proprietary to the Company and cannot be used by any Agent as a sponsored link or for any other unauthorized use. An individual Agent website must clearly indicate that it represents an independent Agent who is not an Agent of the Company or any of its worldwide affiliates.
(e) The Agent must link any independent website(s) to the Company’s official website created and maintained by the Company at www.mysensesworld.com.
(f) All independent Agent websites must reflect and connect only to companies or products that carry the MY SENSES label and be of good moral content.
(g) Electronic Advertising. Independent AGENT websites that have been approved by the Company, or are as part of an online banner or display ads that conform to the Company’s advertising guidelines and have been approved by Company, will be allowed. Online banners or display ads must be submitted to the Company for approval prior to posting online and must link a user to the Company website or an independent AGENT website that has been approved by the Company. All electronic advertising is subject to and controlled by the Company Policies and the Code of Professional Conduct relating to advertising and promotional guidelines.
11 Legal
11.01 Dispute Resolution/Waiver of Jury Trial.
If a controversy or claim arising out of or relating to the Agent relationship or MY SENSES products cannot be resolved by negotiations, the Company and Agent agree that in order to promote to the fullest extent reasonably possible a mutually amicable resolution of the dispute in a timely, efficient and cost-effective manner, he/she will waive his/her respective rights to a trial by jury and settle their dispute by submitting the dispute to the Malaysian Arbitration Association for binding arbitration in Malaysia, in accordance with
the written Dispute Resolution Policy currently in effect and available
on the Company’s website at www.mysensesworld.com. The My Senses Agent Application and Agreement shall be governed in all respects by the laws of Malaysia.
11.02 Testamentary Transfers.
(a) The transfer or assignment of a My Senses Business is prohibited except
in the event of death or legal separation or divorce.
(b) To transfer a single person’s My Senses Business on death, such Agent must have a Will or use of a Grantor’s Trust.
(c) The Company recognizes the Right of Survivorship and use of Grantor Trusts as legal means of holding a My Senses Business and in the event of an Agent’s death, a means of transferring the My Senses Business to the Survivor or named beneficiary respectively without having to go through probate proceeding to get the property to the intended heir.
(d) If the My Senses Business is held in a Business Entity, the death of the primary shareholder will not remove the My Senses Business from the Business Entity so long as the ownership of the Business Entity remains in conformity with Company policies governing ownership of such Business Entity. The transfer will be recognized by the Company when a court order or legal documents addressing the transfer are submitted to and approved by the Company.
(e) Within six (6) months following the date of the Agent’s death, the spouse, trustee or estate representative shall provide notification of such death to his/her management office of MY SENSES. Such notice is to include a certified copy of the death certificate, a certified copy of the Will or Grantor’s Trust, or Court Order, authorizing the transfer of the My Senses Business to a qualified successor. After six (6) months from the date of death, MY SENSES may remove the deceased Agent from the My Senses Business. Giving timely notification and providing the required documentation for a successor’s interest, will be required to prevent a suspension and/or termination of the My Senses Business. If based on valid reasons, a request for a reasonable extension of time to provide transfer documents may be submitted to the deceased Agent’s MY SENSES management office prior to the end of the six (6) month period. MY SENSES reserves the right to make payments to the spouse, beneficiary, trustee or legally authorized personal representative of the estate of a deceased Agent pending the timely submission of appropriate legal documentation.
(f) The inheritable rights to a My Senses Business are limited and restricted as follows:
i) The heir must be a person who can qualify as an Agent.
ii) Because the heir must be an adult individual, a trust or guardianship may have to be established for multiple heirs or minor children. In the event a trust is established, a copy must be placed on file with MY SENSES. Its terms must clearly allow the trustee to act as an Agent. A guardian or a trustee of a testamentary trust must be appointed by the court of proper jurisdiction and receive specific approval to be an Agent on behalf of the minors.
iii) A trustee or guardian shall retain the Agent status so long as the My Senses Agent agreement is not violated, until the beneficiaries have attained the age of majority, and an heir accepts the responsibility of operating the My Senses Business with prior approval of the court.
iv) A trustee, guardian, spouse or other representative-type Agent shall be responsible for the actions of the beneficiary, ward, or his/her spouse for purposes of following the policy terms of the My Senses Agent agreement. A violation of Company Policies and the Code of Professional Conduct by any of the above individuals may result in termination of the My Senses Business.
v) The inheritable My Senses Business position within the Company Marketing Plan is limited to recognition at no higher than that of Associate Agent. However, bonuses shall be paid at the same levels and requirements as held by the deceased. My Senses Business positions below Associate Agent shall be inherited at that level.
12 Restrictive Covenants
12.01
To the extent permitted by law, MY SENSES, its directors, officers, shareholder, employees, assigns and Agents (collectively referred to as “Associates”) shall not be liable for, and the Agent releases MY SENSES and its Associates from and waives all claims, for any loss of profits, indirect, direct, special or consequential damages, and for any other losses incurred or suffered by the Agent as a result of:
(a) Agent’s breach of the My Senses Agent Agreement of MY SENSES Company Policies and the Code of Professional Conduct and Procedures;
(b) the promotion or operation of the Agent’s My Senses Business and Agent’s activities related to it;
(c) Agent’s incorrect or wrong data or information provided to MY SENSES or its Associates; or
(d) the Agent’s failure to provide any information or data necessary for MY SENSES to operate its business, including without limitation, Agent’s enrolment and acceptance into the MY SENSES Marketing Plan and the payment of volume bonuses; or
(e) transfers pursuant to death, legal separation or divorce of an Agent.. EACH AGENT AGREES THAT THE ENTIRE LIABILITY OF MY SENSES AND ITS ASSOCIATES FOR ANY CLAIM WHATSOEVER RELATED TO THE RELATIONSHIP OF AWARENESS INCLUDING, BUT NOT LIMITED TO, ANY CAUSE OF ACTION SOUNDING IN CONTRACT, TORT, OR EQUITY, SHALL NOT EXCEED, AND SHALL BE LIMITED TO, THE AMOUNT OF PRODUCTS AGENT HAS PURCHASED FROM MY SENSES THAT ARE IN RESALABLE CONDITION.
12.02 Limited License to Use Company Marks.
(a) The name “My Senses” and symbols of MY SENSES and other names as may be adopted by MY SENSES including MY SENSES Product names are proprietary trade names and trademarks of the Company.
(b) Each Agent is hereby licensed by MY SENSES to use MY SENSES’s registered trademarks, service marks, and other marks (hereinafter collectively referred to as “Marks”), in conjunction with the performance of the Agent duties and obligations under the My Senses Agent Agreement and the corresponding policies and procedures. All Marks are and shall remain the exclusive property of “MY SENSES”. The Marks may only be used as authorized by the My Senses Agent Agreement and MY SENSES’s corresponding policies and procedures. The license granted herein shall be effective only as long as the AGENT is in good standing and in full compliance with MY SENSES’s policies and procedures. However, it is prohibited for an Agent to claim any ownership of MY SENSES’s Marks (i.e., registering for a domain name using the name “MY SENSES”, or any other MY SENSES Mark in any way, shape or form) unless it has been approved in writing by MY SENSES. These Marks are of great value to MY SENSES and are supplied to each Agent for each Agent’s use in an expressly authorized manner only.
(c) Agents may not use any written, printed, recorded or any other material in advertising, promoting or describing the product or MY SENSES marketing program, or in any other manner, any material which has not been copyrighted and supplied by MY SENSES, unless such material has been submitted to MY SENSES and approved in writing by MY SENSES before being disseminated, published or displayed.
(d) Agents may not alter any packaging, labels, or directions for use for any MY SENSES Products, or recommend that a Product be used in any way other than as indicated by the Company literature.
13 Confidential Information and Nondisclosure Agreement
13.01
a) Agent Sales Reports and all other reports and genealogical information, including, but not limited to, agent sales organization information and commission recap statements, are private, proprietary and confidential to MY SENSES.
(b) Every Agent who is provided with such information must treat it as private and confidential and take care to maintain its secrecy and refrain from making any use thereof for any purpose other than the management of their downline sales organization.
(c) An Agent may have access to private and Confidential Information which he/she acknowledges to be proprietary, highly sensitive and valuable to MY SENSES’s business and is being made to him/her solely and exclusively for purposes of furthering the sale of MY SENSES products and prospecting, training and sponsorship of third parties who may desire to become Agents and to further build and promote his/her MY SENSES business.
(d) “Trade Secret” or “Confidential Information” shall also mean information, including a formula, pattern, compilation, program, device, method, technique or process, that:
i) derives independent economic value, actual or potential, from not being generally known to other persons who can obtain economic value from its disclosure or use; and
ii) is the subject of efforts that are reasonable under the circumstances to maintain its secrecy.
(e) Whenever MY SENSES makes information available to the Agent, it shall be for the sole purpose of conducting MY SENSES business.
(f) An Agent is prohibited from using, disclosing, duplicating or otherwise making any Trade Secret or Confidential Information available to anyone other than Agents, without the prior written consent of MY SENSES.
(g) An Agent is prohibited from, directly or indirectly, using, capitalizing upon or exploiting any Trade Secret or Confidential Information for his/her own benefit, or for the benefit of anyone else, other than for the purpose of conducting his/her MY SENSES business.
(h) An Agent shall maintain the confidentiality and security of the Trade Secret and Confidential Information in his/her possession and to protect against disclosure, misuse, misappropriation or any other action inconsistent with MY SENSES’s rights.
(e) Further Restrictive Covenants. In consideration to MY SENSES for the receipt of Trade Secret or Confidential Information, the Agent inherently agrees that for the term of the My Senses Business, the Agent shall not take or encourage any action, the purpose or effect of which would be to circumvent, breach, interfere with or diminish the value or benefit of MY SENSES’s contractual relationships with any AGENT. Without limiting the generality of the foregoing, for the term of the My Senses Business, the Agent agrees not to directly or indirectly, contact, solicit, persuade, enroll, sponsor or accept any Agent, MY SENSES customer or anyone who has been an Agent or Customer for the last twelve (12) months, into, or to encourage any such person in any way to promote, opportunities in marketing programs of any direct sales company other than MY SENSES.
(f) The agreements contained in the “Confidential Information” section of these policies shall remain My Senses and in perpetuity. The agreements contained in the “Further Restrictive Covenants” section of these policies shall remain in full force and effect during the term of the previously executed My Senses Agent Agreement between MY SENSES and the Agent, and thereafter until the later of one (1) year from the latest receipt of any Confidential Information or twelve (12) months after the expiration and termination of such My Senses Agent Agreement.
14 Code of Professional Conduct
14.01 Integrity, Respect, Diligence
We take great pride in not only on what we achieve, but how we achieve it. In fact, much of the Company’s appeal to prospective new Agents is its well-deserved legacy of integrity, the respect we show to others and the diligence with which we build successful My Senses businesses. As an Agent, we invite you to examine more closely your role in maintaining these core values and the underlying standards of conduct in a manner that will add to our legacy and ensure our long term mutual success. Failure to abide by the principles outlined in the Code of Professional Conduct may result in disciplinary action up to and including termination.
14.02 Effort, Sacrifice and Dedication
My Senses Agents teach the principles of professional and ethical business practices to their agent teams, emphasizing that, like any other worthy pursuit, it requires effort and sacrifice to be successful. 14.03 Agents Are Builders
My Senses Agents are builders. They build their individual retail businesses, their first line referred business agents and their agent team. There is no place for tearing down, dismantling or discouraging others from building their respective businesses.
14.04 No Medical, Lifestyle or Income Claims
My Senses Agents are truthful when prospecting by not making exaggerated claims about the Company, the capabilities of its products or the rewards available within its Marketing Plan whether in person or via social media. This includes medical claims and income projections of any kind.
14.05 Loyalty
My Senses Agents are loyal to the Company, its staff and representatives, and fellow Agents at all times, avoiding gossip, criticism and internal ‘politics’.
14.06 Proud Professional Online Seller
(a) My Senses Agents look and act the part of a proud professional online seller.
14.07 Teach Good Marketing Principles
My Senses Agents teach their Agents and teams good principles of marketing and personal conduct.
14.08 Positive Attitude
My Senses Agents display a positive attitude in both speech and behavior, whether in person or via social media, to all Agents, in a spirit of co-operation and teamwork.
14.09 Support Fellow Agents
My Senses Agents are willing to help their own teams as well as give support to fellow Agents and their teams so that all benefit from a successful, vibrant, active local community of Agents.
14.10 Compliance With Company Policies, Code of Professional Conduct, DSA Code of Ethics
My Senses Agents are aware of and comply with all aspects of the Company Policies, Code of Professional Conduct, and the Malaysia Law.
14.11 Participation in Company Events
My Senses Agents at the Associate Agent Level attend a majority of Company events, and promote Company events to their Agent team.
14.12 Lead By Example
My Senses Agents lead by example by referring new frontline Agents, achieving monthly sales target and striving to qualify as Associate Agent and to all the incentives.
14.13 Integrity in Sponsoring
My Senses Agents insist that prospective Agents are sponsored under the Agent who introduced them to the My Senses Opportunity; and refrain from sponsoring another Agent’s prospect.
14.14 Dealing with Challenges, Issues and Problems
My Senses Agents deal with challenges, issues and problems personally and do not share them with Agents who are not personally involved, nor post them on social media. They use proper lines of communication for seeking answers or expressing concerns, beginning with their referrer and moving up to their Leader and to the Company for further inquiry.
14.15 Refrain from Promoting Non-My Senses Product or Service
(a) My Senses Agents refrain from promoting and/or selling any non-My Senses product or service that has direct competition with My Senses.
14.16 Persuading AGENTs to Terminate
(a) My Senses Agents refrain from, in any manner, inducing, coercing or persuading any other Agent to terminate his or her position, cease doing business or reduce his or her business building activities for any reason.
14.17 Advertisement of Selling Price of Product
My Senses Agents refrain from any form of advertising of our products at any price below the Suggested Retail Price. This includes a stated price or any other pricing formula that reduces the price paid for any My Senses product to below that of Standard Retail Price.
